Copyright Policy

Last Updated: January 24, 2025

Genery ("we," "us," or "our") respects intellectual property rights and is committed to complying with the Digital Millennium Copyright Act ("DMCA") and other applicable intellectual property laws. This Copyright Policy outlines our procedures for addressing claims of copyright infringement and how we handle counter-notifications.

At Genery, our goal is not to compete with copyright holders but to enhance the creative ecosystem by providing a platform that inspires creators. We strictly prohibit the use of content for any commercial purposes. All content provided on our platform is shared under the principles of the Fair Use doctrine. We hold the creators of every work featured on our platform in the highest regard, considering each of them a genius.

1. DMCA Compliance

We have designated a Copyright Agent to receive notifications of claimed copyright infringement. You can contact our Copyright Agent at the details provided below. We will act expeditiously to remove or disable access to material that is claimed to be infringing and will take reasonable steps to notify the affected user.

3. Filing a Notice of Copyright Infringement

If you believe that your copyrighted work has been infringed, please submit a written notice to our Copyright Agent including the following information:

  1. Identification of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the infringing material and information reasonably sufficient to enable us to locate the material (e.g., URL).
  3. Your contact information, including your name, address, telephone number, and email address.
  4. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner.
  6. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

4. Responding to a Counter-Notice

If your content has been removed due to a copyright claim and you believe this removal was in error or that the material is non-infringing, you may submit a counter-notice to our Copyright Agent. A valid counter-notice must include:

  1. Identification of the removed content and the location where it appeared before removal.
  2. Your contact information, including your name, address, telephone number, and email address.
  3. A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled due to a mistake or misidentification.
  4. A statement that you consent to the jurisdiction of the federal court in [your jurisdiction] and will accept service of process from the person who submitted the infringement claim.
  5. Your physical or electronic signature.

Upon receipt of a valid counter-notice, we will provide a copy to the original claimant and inform them that we may restore the removed material within 10-14 business days unless we receive notice that the claimant has filed a court action.

5. Repeat Infringers

We reserve the right to terminate user accounts or access for repeat infringers in accordance with the DMCA and applicable law.

6. Limitations of Liability

We cannot act as an arbiter of copyright disputes and will not be held liable for damages incurred by removing or disabling access to material in response to a claim of infringement. If you are unsure whether your use of copyrighted material constitutes infringement, we recommend consulting an attorney.

7. Revision of Policy

We may update this Copyright Policy from time to time. Any changes will be posted on this page with an updated "Last Updated" date. By continuing to use Genery’s services, you agree to this policy and any updates.

8. Additional Inquiries

For issues unrelated to copyright infringement, such as other intellectual property concerns or violations of our terms of use, please contact us at support@genery.io.
